 NCVO WORKFORCE DEVELOPMENT ‘TUPE’: TRANSFERRING EMPLOYMENT RIGHTS TO AND FROM YOUR ORGANISATION

1. Introduction

In the voluntary sector, funding for particular projects is often of limited duration. At the end of the funding period, the funding may be renewed, may cease, or the funding and responsibility for the project may pass to another organisation. 

Third sector organisations may also change in other ways. For example, one organisation may be taken over by another, or two organisations with similar charitable objectives may merge.

In situations where the transfer of a project, organisation or part of an organisation takes place, The Transfer of Undertakings (Protection of Employment) Regulations 2006 (‘TUPE’) may apply.

The report looks at the proposals and implications flowing from the coalition government’s announcements, particularly the October 2010 spending review announcements and their effects on Hackney residents. Turning to the Ways into Work programme, the authors look at the programme’s effectiveness, define the economic impact of the model and assess its broader social impact. This is all set against the forecasts for Hackney for those exiting the labour market and the likely employment opportunities that the borough will be able to generate.

 The primary purpose of this report is to inform NOMS about the current level of activity of social enterprises working with prisons and probation services in England. Its secondary purpose is to assist the social enterprise sector to position itself to develop new opportunities identified by the findings.
